                   AN ORDINANCE CLOSING AND ABANDONING WEST
                   36TH STREET, A 50-FOOT-WIDE UNOPENED RIGHT-
                   OF-WAY LOCATED SOUTHEAST FROM FREDERICK
                   STREET, BETWEEN WEST 35TH STREET AND WEST
                   37TH STREET; A 10-FOOT-WIDE UNOPENED
                   ALLEYWAY LOCATED SOUTHEAST FROM FREDERICK
                   STREET BETWEEN WEST 35TH STREET AND WEST
                   36TH STREET; AND A 10-FOOT-WIDE UNOPENED
                   ALLEYWAY LOCATED SOUTHEAST FROM FREDERICK
                   STREET BETWEEN WEST 36TH STREET AND WEST
                   37TH STREET, MORE PARTICULARLY DESCRIBED
                   HEREIN, UPON CERTAIN CONDITIONS.
                  
                  
                                                    
                  
                  
       	    	 SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
       CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
       and abandoned West 36th Street, a 50-foot-wide unopened right-of- 

       way located southeast from Frederick Street, between West 35th
       Street and West 37th Street; a 10-foot-wide unopened alleyway
       located southeast from Frederick Street between West 35th Street
       and West 36th Street; and a 10-foot-wide unopened alleyway 
located
       southeast from Frederick Street between West 36th Street and West 

       37th Street, more particularly described as shown on a plat
       attached hereto and made a part hereof by reference.
       	    	 SECTION 2.  BE IT FURTHER ORDAINED, That this closure
       and abandonment is made subject to the following conditions:

            1.	 Subject to approval of City Engineer and all public
                 utilities.
           
            2.	 The areas reserved for utility easements must be
                 kept free and clear of all structures.
           
            3.	 All existing easements are retained.
           
       	    	 SECTION 3.  BE IT FURTHER ORDAINED, That this Ordinance
       shall be effective two (2) weeks from and after its passage as
       provided by law.
